Guarantees of realization of the right of citizens to work.
State guarantees in the field of employment. Citizens of the Russian Federation are guaranteed: freedom to choose the type of activity, profession (specialty), type and nature of labor; unemployment protection; free assistance in the selection of a suitable job and employment through the mediation of the employment service;
In accordance with the Constitution of the Russian Federation - Russia, everyone has the right to work that he freely chooses or to which he freely agrees, the right to dispose of his abilities for work, to choose a profession and occupation, as well as the right to protection from unemployment.
The basic labor rights and obligations of an employee are set out in Article 2 of the Labor Code of the Russian Federation. Forced labor is prohibited.
Every employee has the right:
- on working conditions that meet the requirements of safety and hygiene;
- for compensation for damage caused by damage to health in connection with work;
- to equal remuneration for equal work without any discrimination and not below the minimum amount established by law;
- for rest, provided by the establishment of the maximum duration of working hours, reduced working hours for a number of professions and jobs, the provision of weekly days off, holidays, as well as annual paid holidays;
- to join trade unions;
- for social security by age, in case of disability and in other cases established by law;
- on judicial protection of their labor rights.
The state guarantees citizens permanently residing on the territory of the Russian Federation:
- freedom to choose the type of employment, including work with various modes of work;
- free assistance in the selection of a suitable job and employment from the federal employment service;
- provision by enterprises, institutions, organizations, in accordance with their pre-filed applications, of suitable work for graduates of educational institutions;
- free training in a new profession (specialty), advanced training in the system of the employment service or in its direction in other educational institutions with the payment of a scholarship;
- compensation of material costs in connection with the direction to work in another area at the suggestion of the employment service;
- the possibility of concluding fixed-term employment contracts (contracts) for participation in paid public works, organized taking into account the age or other characteristics of citizens;
- legal protection against unjustified dismissal.
In turn, employees are obliged to work honestly and conscientiously, observe labor discipline, timely and accurately execute the orders of the administration, increase labor productivity, improve product quality, comply with technological discipline, safety requirements and industrial sanitation, take care of the property of an enterprise, institution, organization.
The employee is obliged:
- conscientiously fulfill labor duties;
- observe labor discipline;
- take care of the property of the enterprise, institution, organization;
- comply with established labor standards.
